Applicants who would like to apply for the SBO pathway need to meet 2 series of criteria:

  • Department of Home Affairs Immigration Eligibility Criteria and
  • The Criteria of the State they apply to for the chosen visa category

The Department of Home Affairs eligibility criteria are:

Small business owner visa in regional Queensland

Migration Queensland criteria require you to:

  • have an occupation on the Legislative Instrument (LIN 19/051);
  • operate the business successfully for at least 6 months prior to EOI or 2 years for start-ups;
  • be on a visa that allows full-time work rights and operation of the business (minimum of 35 hours per week);
  • have purchased an existing business in regional Queensland;
  • Note: This is not available for home-based businesses. Franchise businesses must have been operating for at least 2 years prior to purchase in the current location.
  • Purchased a business for a minimum of $100,000, OR have been operating a profitable start-up for a minimum of 2 years with a turnover of $200,000 in the year directly prior to application.
  • have 100% ownership of the business – partnerships or joint ventures are not eligible;
  • have been trading in the business for 6 months before applying;
  • employ 1 employee who is an Australian resident, working a minimum of 20 hours per week;
    • Note: An Australian resident in this situation is an Australian permanent resident, Australian citizen, or a New Zealand citizen on a Special Category visa (subclass 444). and
  • provide evidence of sufficient settlement funds.

Migration Tasmania Criteria Small business owner visa

Tasmania offers an SBO pathway under the Visa Subclass 491. Here are some of the major conditions:

Be living in Tasmania when you lodge your 491 application. – Have established and operated your business for at least six months. – Show that the business would offer you a personal income that exceeds the taxable income requirement set by the Department of home affairs ($53,900 per year at the time of writing) for at least three years in the next five years.

-Provide a comprehensive business plan, including evidence of research and understanding of the target market, relevant industry conditions, and licensing or registration requirements. – Prior business ownership or business management experience.

Unfortunately, not all the businesses can apply for this pathway, the unqualified business is:

  • Franchises
  • Share-owned businesses
  • Service stations
  • Massage clinics
  • Taxi/Uber-related businesses.

ACT nomination process for Small business owner visa

Recently, the ACT Government just announced that they are adding one more stream into their Skilled Migration program, which is the Small Business Owner (SBO) pathway. Accordingly, as of July 2021, there are 3 states in Australia that have in place a migration stream for a small business owner, namely Queensland, Tasmania, and ACT.

Your business in Canberra must meet the following minimum criteria to apply under the SBO stream:

  • Ownership: You must own at least 51% of a registered business located and actively operating in the ACT.
  • Turnover: your business must have a minimum turnover of AUD $200,000 per annum (or pro-rata).
  • Length of operation: your business must have actively traded in Canberra for at least 6 months from the date established or purchased.
  • Your business must be profitable. The profit can be as small as $1.
  • Your salary: Your business must be paying you the following salary immediately before the date of Matrix submission:
  • 190 nomination: at least $26,000 for six months.
  • 491 nomination: at least $13,000 for three months.
  • Employee: You must employ at least one Australian citizen, permanent resident, or New Zealand citizen for at least 13 weeks (minimum of 20 hrs per week).
  • You may employ one or more employees. Employment does not have to be continuous.
  • The employment must be in accordance with Australian legislation.
  • You MUST provide a statutory declaration confirming the employment and citizenship details for each employee.

The following business types are not eligible for the SBO stream:

  • Sub-tenancy
  • Ride-share, taxi
  • Courier services
  • A business that has been used to qualify for ACT nomination.
