Lodged on 14/ 03/2023 Family 3 Occupation code 313111(Hardware Technician )/ SA 1st s 56 on 23 July 2024= Office phone no ( provided same day) 2nd s56 for police clearance for me and husband on 23 may 2024 3ed s56 for re medicals on 16 december 2024, updated by medical center on 28 december S56 police clearance for daughter on 21 March 2025. Submitted on 27 March.
Granted : 19 September 2025 It is 30 months of waiting !

I got an S56 for our 189 application and it's for Evidence of functional English for partner. They stated that they received her PTE records from 2023, but it doesn't match the requirements for functional english since it's more than 12 months before visa application. However, her PTE score is superior, and in their website, they stated that it is valid for 3 years. What should be the correct way to approach this?
"You achieved one of the test scores in Table 2 or Table 3 in the 12 months before your visa application." Check here
I see. This is confusing since in the 189 points checklist:
"Your spouse or de facto partner must also be an applicant for this visa and meet age, English and skill criteria
For you to be eligible for the award of these points your partner must be an applicant for the same visa subclass and must not be an Australian permanent resident or an Australian citizen. Additionally, you will need to provide evidence that when you were invited to apply for this visa that they: ... - had competent English ..."
Why would it be necessary to provide evidence for "functional" English if she already has evidence of "competent" English? Should we consult a lawyer now?
Probably best to clarify with migrant agent/lawyer. I am just an applicant like yourself (but for study visa)
@tensor, in my own understanding, if you are not claiming point for a partner, all they require is functional English, and the test must be within 12 months; it does not matter if the partner has superior or competent. The 3-year rule applies if you want to claim point and the minimum is competent.
@evelyn, that's also my understanding and that it is our situation. We claimed partner points so we provided the "competent" English requirement. However, now they are asking for proof of "functional" English, which is a bit hard to understand why.
For Functional English, the test must be taken within 12 months before the visa application. Your spouseโs English test was older than 12 months at the time of your visa application, which is why you received an s56 request. If you had claimed 5 points for your spouseโsince your spouse achieved a superior scoreโthis s56 request would not have occurred.
@tensor, please may I know if they queried claiming points with the score of more than 12 months, or just to fulfil the functional English requirement? This is really confusing
