I got an S56 for our 189 application and it's for Evidence of functional English for partner. They stated that they received her PTE records from 2023, but it doesn't match the requirements for functional english since it's more than 12 months before visa application. However, her PTE score is superior, and in their website, they stated that it is valid for 3 years. What should be the correct way to approach this?

I see. This is confusing since in the 189 points checklist:

"Your spouse or de facto partner must also be an applicant for this visa and meet age, English and skill criteria

For you to be eligible for the award of these points your partner must be an applicant for the same visa subclass and must not be an Australian permanent resident or an Australian citizen. Additionally, you will need to provide evidence that when you were invited to apply for this visa that they: ... - had competent English ..."

Why would it be necessary to provide evidence for "functional" English if she already has evidence of "competent" English? Should we consult a lawyer now?

@tensor, in my own understanding, if you are not claiming point for a partner, all they require is functional English, and the test must be within 12 months; it does not matter if the partner has superior or competent. The 3-year rule applies if you want to claim point and the minimum is competent.

@evelyn, that's also my understanding and that it is our situation. We claimed partner points so we provided the "competent" English requirement. However, now they are asking for proof of "functional" English, which is a bit hard to understand why.

For Functional English, the test must be taken within 12 months before the visa application. Your spouse’s English test was older than 12 months at the time of your visa application, which is why you received an s56 request. If you had claimed 5 points for your spouse—since your spouse achieved a superior score—this s56 request would not have occurred.

@tensor, please may I know if they queried claiming points with the score of more than 12 months, or just to fulfil the functional English requirement? This is really confusing

@evelyn, apologies for the confusion. To clarify the situation: in our application, we claimed and provided evidence for partner skills. The criteria to get this is for the partner to have "competent" English, and the test results are valid for 3 years as stated in @biotechy's link. Our confusion now is: why is it needed to provide evidence of "functional" English when it was not listed in the requirements. Perhaps some of the requirements changed?
